A method to build a media buying agency disclosure policy from an incentive register
A method for media buying agencies in England to build a disclosure policy from an incentive register, with owner, notice and correction steps.
A disclosure policy should tell staff when a relationship, payment or incentive must be recorded, reviewed and explained to the audience. It should not impose one repeated disclaimer on every situation. The words needed for creator advertising differ from the internal record needed when an agency recommends inventory in which it has an interest.
This method is for advertisers and media buying agencies in England. Two bodies of rules govern the work: section 2 of the CAP Code, which requires that marketing communications are obviously identifiable as such, and the consumer-protection law — the Consumer Protection from Unfair Trading Regulations 2008 (CPRs), with the Digital Markets, Competition and Consumers Act 2024 carrying the replacement regime. ISBA, the advertiser body, sits behind much of the UK industry guidance for brands. Have a qualified UK reviewer approve the policy and any campaign-specific wording.
What to take away
- Build a register of agency benefits before writing any disclosure notices.
- Match public disclosure to where the reader encounters the claim or recommendation.
- Assign owners for declarations, checks, approvals and pausing publication.
- Record exceptions with reasons, decision maker and expiry date.
- A sponsorship label does not validate the product claim beside it.
Build a register before writing notices
Ask agency teams, procurement and finance to record benefits connected with planning or buying. Relevant entries can include fees, commissions, rebates, free inventory, credits, volume arrangements, affiliate income, hospitality, ownership links and supplier incentives. Record the party, value or calculation method, affected decision, dates, recipient and reviewer. There is no statutory register of agency benefits in the UK, but a public model exists: the approach taken by the financial services regulator to the Consumer Protection from Unfair Trading Regulations 2008 (CPRs) is a model for a Register.
Worked example: party, Media Owner A. Value, quarterly volume rebate of 5 per cent (illustrative). Affected decision, whether to recommend Media Owner A. Reviewer, agency compliance lead. Declared 1 May 2026; review by 1 November 2026.
Benefit to response: the rebate could affect that recommendation. Response: remove the buyer from the final selection, compare at least two other media owners, obtain compliance approval and disclose the rebate beside the recommendation.
Incentive register fields

- Affected decision
- Dates
- Recipient
- Reviewer
Do not label every benefit a conflict. First establish whether it could affect a recommendation or how an audience interprets content. Then choose a response: prohibit it, remove the person from the decision, compare alternatives, obtain approval, disclose it, or combine those controls.
Proprietary media, principal-based buying and preferred-supply arrangements raise the same question: the underlying arrangement and written contract matter more than the category name. Ask the agency to explain ownership, pricing basis, alternatives and data treatment in writing, and check the answers against the register entry.
Existing advertiser and agency contracts may already cover audit rights, rebates and remuneration disclosure. The register should feed those obligations, not replace them.
Match the notice to the reader's decision
Public disclosure belongs where someone encounters the affected claim or recommendation. A remote policy page may provide background, but it cannot make an advertisement recognisable at first contact.
The ASA and CAP publish the Influencer's guide to making clear that ads are ads and influencer marketing resources for brands, agencies and publishers. Work through the guide before agreeing the public wording.
The CMA's guidance Social media endorsements: being transparent with your followers, part of its online reviews and endorsements collection, separates advice by role. Use the material for the actual relationship and format, then review the full execution on the intended device.
A good notice names the commercial nature plainly and uses the platform's own tool where one exists — the paid partnership label on Instagram, the paid promotion disclosure on YouTube or the branded content toggle on TikTok — alongside the wording in the post itself. Avoid internal terms that an ordinary reader cannot decode. Test its position, timing, contrast and persistence. If content is shortened, reposted or adapted into another format, repeat the review instead of assuming the earlier label travelled with it.
Before: 'Some links may earn us commission.' After: 'This is a paid partnership with Brand X. We received a fee for this post.' Internal-only record: 'Brand X paid partnership. Fee: GBP 2,500 (illustrative). Affected decision: feature Brand X in the best-buy list. Reviewer: compliance lead. Approved: 1 May 2026. Review by: 1 November 2026.'
Assign declaration owners and evidence
The policy should identify who declares a relationship, who checks it, who approves public wording and who can pause publication. Join those steps to campaign approval. Keep the declaration, decision, final notice and released asset under the same identifier.
Include a route for late changes. A creator may receive a product after the original brief; a trading desk may switch inventory; a publisher may add an incentive. Require prompt updates and state when a fresh approval is mandatory.
Do not let disclosure distract from claim accuracy. Section 2 of the CAP Code requires that marketing communications are obviously identifiable as such; section 3 covers misleading claims, substantiation, qualifications and comparisons in UK non-broadcast marketing. A clear sponsorship label does not validate the product statement beside it.
Handle exceptions and corrections
If a team decides that no public notice is needed, record why, who decided and when that reasoning expires. Keep internal commercial transparency even when no audience-facing disclosure follows. Review recurring arrangements on a schedule and whenever ownership, remuneration or format changes.
Give complaints and corrections an owner too. Anyone can complain about a notice that is absent or unclear through the ASA's online complaints form, and the CMA can act against misleading commercial practices under the consumer-protection law. If a notice was absent or unclear, preserve the affected material, correct it promptly and feed the cause back into briefing and approval.
Before publication, sample actual posts, native placements and buying recommendations against the policy. This article was prepared through desk research on 5 September 2026. No agency relationship, creator agreement or disclosure implementation was tested.
Before you act
- Record agency benefits in a register with reviewer and dates.
- Decide a response for each benefit that could affect recommendations.
- Test notice position, timing, contrast and persistence on the device.
- Join disclosure steps to campaign approval and keep evidence together.
- Preserve affected material and correct unclear notices promptly.
- Sample actual posts and buying recommendations against the policy.
Common questions
What should a disclosure policy tell staff to do?
It should tell staff when a relationship, payment or incentive must be recorded, reviewed and explained to the audience. It should not impose one repeated disclaimer on every situation, because creator advertising needs different words from an internal record about agency-recommended inventory.
How should a team decide whether a benefit is a conflict?
First establish whether the benefit could affect a recommendation or how an audience interprets content. Then choose a response: prohibit it, remove the person from the decision, compare alternatives, obtain approval, disclose it, or combine those controls. Do not label every benefit a conflict.
What should happen if no public notice is needed?
Keep internal commercial transparency even when no audience-facing disclosure follows. Review recurring arrangements on a schedule and whenever ownership, remuneration or format changes.
